If a person has an application or petition that has been pending for longer than the processing times claimed by USCIS then the person may be entitled to have the backing of a federal court order called Writ of Mandamus that requires USCIS to immediately adjudicate their application.

Upon filing the Petition for Writ of Mandamus the government has 60 days to respond to the complaint. Many times USCIS will adjudicate the application based on the strength of the claim prior to responding to the petition.
